Lessons from the 2G scam trial                                    These are indeed extraordinary times. How else should one interpret the order that's been delivered while denying bail to the likes of Kanmozhi and others. This was a case where the CBI itself had taken a position that it wasn't opposed to bail being granted to the DMK MP in the 2G scam case.

But the special sessions court Judge, Justice OP Saini, felt otherwise. The judge observed: "A murder may be committed in the heat of moment upon passion being aroused. An economic offence is committed with cool calculation and deliberate design with an eye on personal profit regardless of consequence to community. Rights of accused is important but rights of victims and witness is no less valuable..they should have a sense of safety and security. One way of generating a sense of security is to keep accused in custody till their evidence is complete."

Let's consider the profile of the accused. Kanimozhi is an MP from one of the most powerful political parties. If witnesses have to be influenced, it can easily be done by her family members. Karunanidhi may have lost power on his home turf but he remains an important force to reckon with at the Centre. Other bureaucrats like RK Chandaulia and Sidharth Behura have worked with the high and mighty in the corridors of power. They too can swing things without necessarily getting their own names involved.

So why this insistance on keeping the accused in custody till such time that the trial doesn't get over? Is this a case of judicial over reach? Isn't bail the fundamental right of an accused? Look at the US. One of India's biggest icons, Billionaire investment banker Rajat Gupta, has been declared guilty of insider trading. He faces a maximum punishment of 105 years in jail. He too is accused of committing an economic offence perhaps as grave if not bigger.

A case of cheating is just that, cheating! But he is out on bail. So can he not influence witnesses with his financial clout?

One can, of course, argue that there are several people who spend much more time in jail than even the sentence they would have served if they would have been declared guilty. Only because their trial continues. One can be accused of perhaps being soft on individuals who have committed the biggest fraud in corporate India. But the danger of what we are witnessing becoming a precedent for all times to come is just too big to be ignored.

There is the example of Speak Asia, a company that was involved in carrying out online surveys and polls to figure out consumer trends. This is a company which is running very successful and professional operations in several other countries. In India too, It managed to do good business and provide money to several middle class Indians. Till the time that someone decided to complain against them. Suddenly, everything that they had built had become illegal.

Its COO, A dynamic enterpreneur who used to be with the armed forces earlier, is in jail. Top executives of the company are allegedly on the run and the company's entire business operation is in jeopardy. The situation gets more curious as so far government agencies haven't yet produced any strong evidence against the company. Yet the company is finding the going tough.

So whether its Unitech, Reliance or Speak Asia, the complaint against all these big corporate players is the same, that they cheated. They are all supposed to be powerful enough to manipulate things in their favour. But then if that was indeed the case, How did they fail to manipulate the proceedings earlier? How did all of them land up in jail?

Need of the hour is for the criminal justice system to deliver verdicts quickly. Else India will soon lose its sheen of being the destination for entrepreneurship and growth.

श्री हफीज, क्या मैं पूछ सकता हूँ कहाँ हैं वो १०० से अधिक शिकायतें जिनका आपने लेख में उल्लेख किया था, और कहाँ हैं आपके काल्पनिक MBA graduate श्री शरद यादव, जिन्होंने भारी भरकम १४ करोड़ खो दिए थे. श्री हफीज अब बेवकूफी बंद करो और गंभीर हो जाइए , आप 20 लाख लोगों के कॅरिअर(career ) के साथ खेल रहे हैं.

मैंने आपका ध्यान इस ओर खिंचा था कि ९ अगस्त का सन्देह करने वाला रिपोर्ट आलसी पत्रकारिता का एक नतीजा था और आपका रिपोर्ट गलत जानकारी से भरा था . मैंने मेरा पत्र इस प्रकार समाप्त किया था कि , “भविष्य में ,मैं तुम से अधिक ज्ञानसम्पन्न और संशोधन किये खबरें पढ़ने की उम्मीद रखता हूँ “.

श्री हफीज, आपने मेरी उम्मीदों पर पानी फेर दिया और अब मैं एक निष्कर्ष पे पहुंचा हूँ, कि आप जैसे कम निष्ठा वाले लोग बदलना नहीं चाहते .आप भ्रष्ट पत्रकारिता का प्रतिक हो .यह बहुत स्पष्ट है कि आप उत्प्रेरित हो और

Speakasia online के खिलाफ पक्षपाती हो.मुझे मेरी विचार प्रक्रिया को समझाने के लिए अनुमति दें:

१ .क्या आपकी निजी तमन्ना थी एक न्यायाधीश बनने की और ऐसा लगता है कि आपको पत्रकारिता में कैरियर बनाना मजबूरन करना पड़ा . मुझे लगता है कि आप का निजी अरमान है कि आपको माननीय न्यायमूर्ति श्री हफीज के नाम से बुलाया जाए . आपके लिए मेरी सलाह यह है कि ऐसे संभाव्य घटना के सपने देखना बंद करो, न्यायाधीश बनने के लिए मूलभूत आवश्यकता है बुनियादी बुद्धिमत्ता और इमानदारी की और माफी चाहता हूँ के लिए आप दोनों मुद्दों पे खरे नहीं उतरे हैं.

श्री हफीज अब ज़बकि हमने प्रमाणित किया है कि आप न्यायाधीश बनने के लिए योग्य नहीं हैं, मैं आपसे निवेदन करता हूं कि आप फैसला न सुनाये जैसा कि आपने २४ अक्तूबर, २०११ की आपकी रिपोर्ट में किया है जब आप अपने हानिकारक लेख को “फ्रॉड फर्म COO यद्यपि जमानत पर गायब हो जाता है ” का अनुशीर्षक देते हैं.

श्री हफीज आप पत्रकारिता के अपने मूल कर्तव्यों को छोड़कर बाकी सब कुछ करने के लिए उत्सुक लग रहे हैं, आप एक अति उत्साही अन्वेषक, बहुत चालाक अभियोजक है, और एक बहुत बीमार न्यायाधीश हैं.

2. आप कह रहे है कि, “तारक बाजपेयी गायब हो गए हैं और हम नहीं जानते कि वह कहाँ है” एक अधिकारी ने कहा. आपने चुप्पी साधी है कि अधिकारी कौनसे एजेंसी से है , मुझे यकीन है कि यह अधिकारी EOW से नहीं हो सकता है क्योंकि वे ऐसे गलत टिका टिप्पणी नहीं कर सकते हैं . मुझे आशा है कि आप अपने कार्यालय कैंटीन के अधिकारी के साथ गपशप नहीं कर रहे है, क्योंकि आप जैसे भ्रष्ट पत्रकार अपना समय कटिंग चाय पीकर बिताते हैं . मैं आशा करता हूँ कि इस बार फिर यह अधिकारी आपके मतिब्रह्मित मन का उत्पाद नहीं है , काल्पनिक MBA ग्रैड श्री शरद यादव (उपर्युक्त पैरा ३ देखें) की तरह.

1.आपके हानिकारक रिपोर्ट के पैरा ४ में आप आगे कहते हैं,”कंपनी का निष्क्रिय वेबसाइट” जैसे कि कंपनी ने वेबसाइट बंद कर दिया है . माननीय. न्यायमूर्ति हफीज साहिब

श्री हफीज वेबसाइट चयन से निष्क्रिय नहीं ,वह निष्क्रिय है क्योंकि व्यवस्थापक अधिकार EOW के साथ हैं और जैसे ही EOW वेबसाइट को कंपनी को लौटा देती है, वेबसाइट पूरी तरह से क्रियाशील हो जायेगी .

२. अब यह लगता है कि आप केवल गलत सूचित नहीं हैं , वास्तव में विकलांग हैं, खासकर जब आंकड़े की बात आती हैं. यह ऊपर संदर्भित ९ अगस्त के आपकी पहली रिपोर्ट से भी स्पष्ट है. और अब भी जब आप का कहना है कि यह मामला १४,००० करोड़ रुपए का हो सकता है . कल्पना की कोई सीमा के तहत यह संख्या इतने तक पहुँच सकती हैं

५ वीं कक्षा की मेरी भतीजी हिसाब कर सकती है कि २० लाख X ११०००/ – , १४००० करोड़ नहीं बन सकते. मैं अब काफी निश्चित हूँ न्यायाधीश साहब कि आप केवल भ्रष्ट नहीं हैं, आप एक आलसी पत्रकार भी है जिसे आसानी से किसी के खिलाफ प्रेरित किया जा सकता है, और अब यह लगता है आप हिसाब के लिए पुरानी गिनतारा (abacus) का उपयोग करते हैं, सरजी एक कैलकुलेटर खरीद लीजिये.

३, वाह,हफीजजी,आप मुझे हैरान कर देते हैं, ‘क्या कमाल का दिमाग पाया है आपने’ वाह, अब आपको कहाँ से यह खबर मिली कि प्रधान कार्यालय मुंबई में था और सिंगापुर में नहीं . श्री हफीजजी आप भूल जाते हैं कि शुरू में आप रिपोर्टिंग कर रहे थे कि इस कंपनी का भारत में न कोई कार्यालय है और न कोई स्थायी संस्था (PE) है, और आप आज की रिपोर्ट में कहते हैं कि १००० से अधिक करोड़ बेईमानी से सिंगापुर भेजे गये ,और अब आप अचानक यह खबर लाते है कि SAOL का अपना प्रधान कार्यालय मुंबई में है.

जज साहब आपकी सोच स्थिर कीजिये

४ . हफीजजी , आप आपके भ्रमक रिपोर्ट का अंत करते हैं यह कहके कि सात अधिकारियों के खिलाफ रेड कॉर्नर नोटिस जारी किया गया हैं मैं आप से पूछता हूँ महोदय, वे सात अधिकारी कौन हैं? या एक बार फिर ये सात अधिकारी आपके पक्के बीमार और भ्रमित दिमाग के काल्पनिक पात्र हैं?

श्री हफीज कृपया अपने तथ्यों को सही करें . जमानत की शर्त थी कि सभी संबंधित व्यक्तियों को हर सोमवार और गुरुवार को EOW कार्यालय में उपस्थिथि देनी थी. हालांकि श्री तारक जी अस्पताल में थे और श्री तारकजी को चिकित्सा के आधार पर निजी उपस्थिति से छूट के लिए वकीलों ने आवेदन दायर किया क्योंकि तारकजी का स्वास्थ्य ठीक हो रहा है और उन्हें पूरी तरह आराम की सलाह दी है . वकील निजी उपस्थिति से छूट के लिए नियमित रूप से आवेदन दाखिल कर रहे हैं. यह, किसी भी परिस्थिति में, जमानत कूदने या फरार होने के बराबर नहीं है . श्री हफीज साहब , अपने तथ्यों को रिपोर्ट करने से पहले सत्यापित करें. ओह, मुझे खेद है कि मैं आपको काम करने के लिए कह रहा हूँ , अब हम जान गए हैं कि आप मतिभ्रम पर आधारित रिपोर्ट.करते हैं.

मैंने बार बार दिखाया है कि , आप श्री हफीज के पास एक अधिक उपजाऊ, मतिभ्रमित और एक बीमार दिमाग है . आपको काल्पनिक पात्रों को बनाने की प्रवृत्ति है और आप अल्पकालिक स्मृति खोने की बिमारी से ग्रस्त हैं. आप श्री हफीज बहुत कम निष्ठा के व्यक्ति रहे हैं. मैं पूरे २० लाख Speakasian पैनलइस्ट्स की ओर से आपकी ग़लत साबित खबरों पर मेरी कड़ी आपत्ति दर्शाता हूँ .

SC seeks AP reply on Speak Asia plea

New Delhi: The Supreme Court on Friday sought a reply from the Andhra Pradesh government as to why the FIR registered by its crime investigation department against Singapore-based marketing company Speak Asia Online should not be quashed. Speak Asia, an online survey company, has allegedly duped over 12 lakh investors across India to the tune of R1,300 crore.

A bench headed by Justice HL Dattu sought a reply from the state government after the online firm’s counsel informed the court that notice has been issued in a similar case by another bench.

The firm has challenged Andhra Pradesh High Court’s order that dismissed its plea seeking to quash the criminal proceedings initiated against it. The high court had also vacated the stay on the arrest of Speak Asia’s directors, representatives, officials and employees of the company.

On Monday, a group of about 115 panelists of the company had moved the Supreme Court seeking to recover R150 crore stuck with the beleaguered company.
A bench headed by Justice Dalveer Bhandari while issuing notice to the Centre and others on Monday had given two weeks’ time to Additional Solicitor General Haren Rawal and the company to find out why the income tax authorities had seized its records and if the company had any tax liability.

The court also impleaded CBDT and the Mumbai police as parties in the case. The other respondents are the ministry of finance, RBI, Speak Asia and Singapore-based Haren Ventures, a global distributor of e-magazine.

Speak Asia had assured its investors, also called panelists, commissions if the latter introduced new members and promised lucrative returns through a multi-marketing pyramid model.

The panelists under the controversial multi-level scheme used to conduct online survey for the company in lieu of online payment.

In order to become panelist with Speak Asia, subscription of an e-magazine was necessary after making the payment of R11,000 for a year.
The panelist sought a direction to the company to disburse the payments due to them against the reward points earned by them and also direct Haren to refund the subscription amounts for the period the e-magazine was not provided. They also sought to appoint an independent committee for regulation and monitoring of such public money.

Besides, the panelists want that any investigation should not put an embargo or hitch in the refund process.
